PART A – GENERAL PROVISIONS

§ 1 Provider, Scope, Definitions

(1) The provider and contractual partner is

Leben im Denken e.V.
Stäudach 46, 72074 Tübingen, Germany
Represented by the Board: Andreas Schmitt, David Martin,
Ludger Scharlipp, Elvira Kraus
Register court: Amtsgericht (Local Court) Stuttgart, VR 725573
Email: info@spiritual-activity.org

“Institute for Spiritual Activity” or “ISA” is a name used by Leben im Denken e.V. and not a separate legal entity. The contractual partner is always Leben im Denken e.V. (hereinafter “Provider”, “we”).

(2) Scope. These terms apply to all contracts for participation in our educational and practice offerings – in particular annual and basic courses, summer and autumn courses, seminars, meetings, conferences, individual events, online formats and the provision of digital content via our app and media library (hereinafter collectively “Events”). They apply to all our websites, in particular spiritual-activity.org, basic-exercises.com, herz-denken.com, philosophie-der-freiheit.de, life-after-death.at, leben-nach-dem-tode.de, elemente-meditation.de and anatomie-bewegen.de, as well as to registrations by email or in text form.

(3) Precedence. Deviating or supplementary conditions of an individual Event (e.g. different cancellation periods for in-person events with accommodation) take precedence over these terms, insofar as they are expressly stated in the respective event description. Within these terms, the Special Parts B to E take precedence over the General Part A.

(4) No application of conflicting terms. Terms of the participant do not become part of the contract, even if we do not expressly object to them.

(5) A consumer within the meaning of these terms is anyone who concludes the contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB – German Civil Code).

(6) These terms do not apply to membership in the association Leben im Denken e.V. or to donations. These are governed by the association's articles or the respective separate regulations.

§ 2 Subject Matter of the Contract and Description of Services

(1) The content, scope, dates, duration, format (online, in person, hybrid), participation requirements and price of the respective Event are set out in the event description published on the respective website at the time of registration. This description forms part of the contract.

(2) The core of the Event consists of the written course content – in particular the working materials in printed or digital form, the accompanying letters/meditations and practice prompts – as well as the participant's own practice. Where stated in the event description, the scope of services additionally includes: accompanying video conferences and their recordings, access to the media library and the app, and, for in-person events, the seminar services specified there. Attendance at the conferences is voluntary; the course can also be completed without them. The languages in which content is available are determined in accordance with paragraph 6.

(3) Unless expressly stated otherwise, the following are not included: travel costs to and from the venue, accommodation and meals at in-person events, individual mentoring, and the costs of the internet connection and the participant's own devices.

(4) Materials and working documents. Whether printed materials are a subject of the contract or a dependent ancillary service is set out in the respective event description.

  1. a) If they are an ancillary service, participation is also possible without them; all content is additionally available digitally. If a shipment does not reach the participant in time, we will provide the content digitally.
  2. b) If, according to the event description, they are a subject of the contract – in particular where books are an essential part of the offering – Part E and Annex 1 Section 2 apply in addition. If several volumes are delivered over the course of the Event, their number and the fixed shipping dates are set out in the event description.

(5) Digital participation. The form in which materials are provided depends on the country of residence and the chosen language of participation. If shipping to the country of residence is not possible or the materials are not available in print in the chosen language, participation takes place digitally via the app. The scope of services is otherwise the same. The registration process indicates before completion whether participation will be digital.

(6) Languages. The languages of participation offered for an Event are shown in the registration process. Language support – in particular the interpreting of conferences and the translation of accompanying letters and materials – is provided predominantly on a voluntary basis and offered subject to availability. Whether and to what extent it is provided for individual materials and offerings in the respective language is in some cases decided at short notice. There is therefore no entitlement to all materials being interpreted or every accompanying material being translated into the chosen language. If the chosen language is not available in an individual case, the participant may switch to another language offered; English and German are available throughout. In addition, the conference service's automatic live captioning can be activated in many languages during the conferences. It is machine-generated, not error-free and does not replace human interpreting. The same applies to machine-translated letters.

(7) Changes to the content of services. We reserve the right to change speakers, the schedule and individual content, provided that the change does not substantially alter the overall character of the Event and is reasonable for the participant. We will notify the participant of substantial changes without undue delay in text form; in this case, the participant has a right to withdraw free of charge.

§ 3 Conclusion of the Contract

(1) The presentation of Events on our websites does not constitute a binding offer but an opportunity to register.

(2) By submitting the registration form by clicking the button “Register with obligation to pay” – or by registering in text form by email – the participant makes a binding offer to conclude a participation contract. A separate form is available for registrations of two persons and for registrations in Russian; submitting it likewise constitutes a binding offer.

(3) We will confirm receipt of the registration by email without undue delay. This acknowledgement of receipt does not yet constitute acceptance of the offer.

(4) The contract is concluded when we expressly accept the registration in text form (“registration confirmation”), but at the latest upon provision of access to the Event. Payment of the participation fee constitutes performance of the contract already concluded and is not a prerequisite for its conclusion.

(5) If an introductory conversation, a letter of motivation or any other prerequisite is required for an Event, the contract is only concluded upon our express confirmation of admission. There is no entitlement to admission; a rejection does not require justification. In this case, any payments already made will be refunded in full.

(6) The contractual partner is the registered person. If someone registers additional persons (e.g. couple or buddy registration), the registering person is liable for the fulfilment of the contractual obligations of all persons registered by them and warrants that they are authorised to register on their behalf.

(7) Participation requires the participant to be of legal age, unless the event description provides otherwise.

(8) Contract text. We store the contract text. With the registration confirmation, the participant receives their registration data as well as these terms, including the information on the right of withdrawal, as an attachment by email. The current version is also available at https://spiritual-activity.org/agb/.

(9) Group registrations. For groups of or above the minimum size stated in the event description, one person may register the entire group. That person names the participants with their names and email addresses, chooses the fees and concludes the contract on behalf of all of them; paragraphs 2 to 4 apply accordingly. The registering person alone is obliged to pay and ensures that the participants agree to being registered and are aware of these terms.

For larger groups and for groups wishing to receive separate mentoring, registration takes place via an enquiry form. The enquiry is non-binding; a contract is only concluded by a subsequent agreement in text form in which the number of participants, fees, scope of services and method of payment are specified. The contractual partner is the person or institution named in the agreement. Anything expressly regulated in the agreement takes precedence over these terms; otherwise, these terms apply on a supplementary basis.

§ 4 Participation Fees, Price Categories, Reductions

(1) The amounts shown on the respective website at the time of registration apply. All prices are final prices. Shipping costs for materials, where applicable, are shown separately in the registration process.

(2) VAT. Our educational services are exempt from VAT pursuant to § 4 No. 22 lit. a UStG (German VAT Act); VAT is therefore not shown.

(3) Price categories by country. For some of our Events, we offer fees graduated by country or region in order to enable participation regardless of the economic situation of the country of residence. The decisive factor is the participant's actual place of residence at the time of registration. We are entitled to request suitable proof of this. If a category is evidently chosen incorrectly, we are entitled to charge the difference or – after prior enquiry and a reasonable period – to withdraw from the contract.

(4) Self-selected fee. For many Events, participants choose their own fee within a range shown in the registration process – where applicable within their price category under paragraph 3. The participation fee within the meaning of these terms is the final amount actually agreed after deduction of any reductions; it is the basis of assessment for all provisions referring to the participation fee, in particular for § 7. A fee chosen above the minimum amount is part of the consideration and not a donation for tax purposes.

(5) Status-based reductions. Reductions may be offered for certain groups – in particular school pupils, persons in vocational training or higher education, and repeat participants. Which reductions apply to an Event is shown in the respective registration process. The information is provided as a self-declaration; we are entitled to request suitable proof. Paragraph 3 sentence 4 applies accordingly. For reductions for repeat participants, materials are not delivered again.

(6) Solidarity contributions and reductions. By paying a fee above the minimum amount under paragraph 4, participants help to make participation possible for others. Where offered, participants may make a solidarity contribution in favour of others or claim a reduction. There is no legal entitlement to a reduction. We decide on requests in cases of hardship at our reasonable discretion; a request must be sent in text form before registration to info@spiritual-activity.org.

(7) Couple and buddy registrations. If two persons register together, the conditions stated in the event description apply (e.g. a reduced fee for the second person). If one of the two persons withdraws from or revokes the contract, the reduction for the remaining person ceases as of the date of termination; the difference will be charged pro rata.

(8) Price changes do not affect contracts already concluded.

(9) Scholarships. We may waive the participation fee in whole or in part for individual participants. There is no legal entitlement to this; we decide on requests at our reasonable discretion. The scholarship is personal, non-transferable and applies only to the Event for which it was granted. If the participant cancels or is excluded under § 9 para. 3, the scholarship lapses; § 7 otherwise remains unaffected. If it is granted only after conclusion of the contract, we will refund any amounts already paid to the corresponding extent.

(10) Group fees. Group registrations are subject to separate fees as shown in the registration process. Paragraphs 3 and 4 apply accordingly; paragraphs 5 to 7 do not apply. For registrations via an enquiry form, fees are agreed individually.

§ 5 Payment, Due Date, Default

(1) Unless payment has already been made in the registration process, the participant receives an invoice with the registration confirmation. The invoice amount is due without deduction within 10 days of the invoice date, but no later than the start of the Event.

(2) Payment methods. The payment methods offered in the respective registration process are available: credit card (via Stripe), PayPal and – for participants resident in Germany – payment on invoice by bank transfer. Separate local payment methods may be offered for individual countries. We reserve the right not to offer individual payment methods, or not to offer them in all countries.

(3) Currency and bank charges. Invoicing is in euros unless stated otherwise. For payments from abroad, the participant bears any international transfer, exchange rate and third-party bank charges incurred; the invoice amount must be credited to us in full.

(4) Payment in instalments. Where offered in the event description, the participation fee may be paid in the registration process either as a lump sum or in instalments. The number, amount and due dates of the instalments are set out in the event description and the registration confirmation. For all other Events, payment in instalments is possible by prior individual agreement in text form. No surcharge is charged for payment in instalments; the total amount owed remains unchanged.

(5) Default in instalment payments. If the participant is more than 14 days in arrears with an instalment and fails to pay within a further grace period of 14 days, the entire remaining amount becomes due immediately. If the contract ends before all instalments are due as a result of withdrawal, revocation or exclusion, the fee owed under §§ 6, 7 or 9 becomes due immediately as a lump sum; instalments already paid will be credited.

(6) Default. In the event of default in payment, the statutory provisions apply. After an unsuccessful reminder with a reasonable deadline, we are entitled to block access to the Event, the media library and the app until payment is received; the obligation to pay remains unaffected.

(7) Set-off and retention. The participant may only set off claims that are undisputed or have been finally established by a court. The participant has a right of retention only with regard to claims arising from the same contractual relationship.

§ 6 Right of Withdrawal for Consumers

(1) Consumers have a statutory right of withdrawal. Details, time limits and consequences are set out in the information on the right of withdrawal in Annex 1, which forms part of these terms. A model withdrawal form is included there.

(2) The right of withdrawal exists in addition to the contractual right to cancel under § 7 and is not restricted by it.

§ 7 Cancellation, Rebooking, Substitute Participants

(1) Cancellation by the participant. Irrespective of the right of withdrawal, the participant may cancel the contract at any time in text form. The date on which we receive the declaration at the address stated in § 1 is decisive for calculating the time limits. Goods that are a subject of the contract under § 2 para. 4 lit. b must, upon cancellation, be returned without undue delay and at the participant's own expense. If they are not returned or are returned in a condition no longer fit for sale, we will charge the sale price of the respective edition; this will be credited against the cancellation fee under paragraph 2.

(2) Cancellation fee. In the event of cancellation, the following fees apply – calculated from the start date stated in the event description:

Time of cancellation

Fee

up to 1 week before the start

free of charge

thereafter until the start

€30 processing fee

from the start until the 14th day after the start

25% of the participation fee, but at least €30

from the 15th day after the start

100% of the participation fee
From this point onwards, access to all course content is retained for the agreed period.

(3) Proof of lower costs. The participant reserves the right to prove that we have incurred no damage or significantly less damage. We reserve the right to prove higher damage.

(4) Substitute participants. Until the start of the Event, the participant may nominate another person to participate in their place, provided that this person meets the participation requirements and we consent; consent may only be refused for good cause. In this case, no cancellation fee is charged.

(5) Rebooking. Rebooking to a later run of the same Event is possible in exceptional cases and by prior arrangement. The decision rests with us. Any price difference may have to be paid.

(6) Cases of hardship. In justified cases (in particular illness, bereavement, unforeseeable personal emergency), we may waive the cancellation fee in whole or in part. There is no entitlement to this.

(7) Termination for good cause remains unaffected for both parties.

(8) Relationship to the right of withdrawal. If the contract also includes the delivery of goods that are a subject of the contract (§ 2 para. 4 lit. b), the withdrawal period under Annex 1 Section 2 may extend beyond the start of the Event. As long as it is running, the statutory consequences of withdrawal take precedence over the provisions of this section.

(9) Cancellation by individual group members. In the case of group registrations, the registering person may nominate a substitute for individual participants until the start of the Event; no processing fee is charged for this. If an individual group member cancels without a substitute, paragraph 2 applies accordingly to that member's fee. The contract remains unaffected for the other participants, even if the group thereby falls below the minimum size.

§ 8 Minimum Number of Participants, Cancellation and Postponement by the Provider

(1) Events may be cancelled if the minimum number of participants stated in the event description is not reached. Cancellation will be communicated in text form no later than 10 days before the start.

(2) We may also cancel or postpone an Event in the event of force majeure, official orders, short-notice unavailability of speakers or for other serious reasons for which we are not responsible.

(3) We are entitled to convert an in-person event in whole or in part into an equivalent online format if holding it in person is not possible or not justifiable for the reasons stated in paragraph 2. Costs saved (in particular for accommodation and meals) will be refunded. If the change is unreasonable for the participant, they may withdraw free of charge.

(4) In the event of cancellation, participation fees already paid will be refunded in full without undue delay. Further claims – in particular for reimbursement of travel, accommodation or loss-of-earnings costs – exist only in accordance with § 13.

§ 9 Cooperation, Conduct, Exclusion

(1) The Events depend on the participants' own independent practice and active involvement. Participation without one's own involvement may considerably limit the benefit; there is no entitlement to any particular result.

(2) Participants undertake to behave respectfully and in a manner that does not disrupt the Event – online as well as in person. Advertising one's own or third-party offerings, soliciting participants, and ideological, political or commercial agitation within the framework of the Event are not permitted.

(3) We are entitled to exclude from further participation any participants who, despite a warning, persistently cause disruption, endanger others or breach essential obligations under these terms. In serious cases, exclusion may take place without prior warning. In this case, there is no entitlement to a refund of the participation fee; § 7 para. 3 applies accordingly.

(4) Confidentiality. What participants share about themselves in discussion and practice groups must be treated confidentially and may not be passed on outside the group. This obligation continues beyond the end of the Event.

§ 10 Nature of the Offering, Personal Responsibility

(1) Our Events are educational, study and practice offerings in the field of spiritual science, the training of thinking and meditation. They do not constitute medical treatment or medical, psychotherapeutic, psychological, legal or financial advice, nor do they replace such. We make no promises of healing and make no diagnoses.

(2) Participation is at the participant's own responsibility. Participants decide for themselves on the type, extent and intensity of their practice and on continuing or interrupting their participation.

(3) We recommend that persons who are undergoing medical or psychotherapeutic treatment or who suffer from a mental illness discuss their participation in advance with the professional treating them. Ongoing treatment should not be discontinued because of participation without professional consultation.

(4) Participants are requested to inform us of circumstances that are relevant to the running of the Event (e.g. mobility restrictions at in-person events). There is no obligation to disclose health data.

§ 11 Copyright and Rights of Use

(1) All content provided in the context of the Events – lectures, recordings, scripts, letters, card sets, graphics, audio and video files, app content – is protected by copyright.

(2) The participant receives a simple, non-transferable right of use, limited in time to the period of provision, exclusively for their own private purposes.

(3) In particular, the following are not permitted: reproduction beyond private use, disclosure to third parties, making content publicly available, uploading to networks or social media, editing, translation, commercial use, and making and distributing one's own recordings, screenshots or screen recordings.

(4) Access data and access links are personal and may neither be passed on nor made publicly available. In the event of a violation, we are entitled to block access and to exclude the participant under § 9 para. 3; further statutory claims remain unaffected.

(5) Participants' own contributions posted in forums, chats or group workspaces remain their intellectual property. They grant us the simple right to store these contributions technically within the framework of the Event and to make them accessible to the other participants.

§ 12 Certificates

Upon request, we will issue a certificate of attendance after completion of an Event. This does not entail any entitlement to a state-recognised qualification or any authorisation to pass on the content.

§ 13 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, for damage based on intent or gross negligence, as well as under the German Product Liability Act and to the extent of any guarantee assumed.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract at the time of conclusion of the contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the participant may regularly rely.

(3) Otherwise, liability is excluded.

(4) The above limitations also apply in favour of our legal representatives, employees, speakers and vicarious agents.

(5) We accept no liability for the accuracy and completeness of the content of lectures and working materials, unless there is intent or gross negligence. The content reflects the views of the respective speakers.

(6) We are liable for loss of or damage to items brought along to in-person events only in accordance with paragraphs 1 and 2.

§ 14 Data Protection, Photo and Audio Recordings

(1) We process personal data exclusively in accordance with the GDPR. Details – in particular regarding purposes, legal bases, storage periods, service providers used and the rights of data subjects – can be found in our privacy policy at https://spiritual-activity.org/datenschutz/.

(2) Recording of conferences. We record the course conferences and make the recordings available in the app to participants of the same cohort. Only the lecture is recorded; the participants' video tiles are not visible in the recording. Depending on the course, contributions from participants may be audible. Participants may switch off their camera and microphone at any time and participate under a name of their choice. The recordings generally remain available for approximately one year after the end of the course; there is no entitlement to any particular period of availability.

(3) Photos and other publications. We publish photos of in-person events and other recordings in which participants are recognisable only on the basis of separate, voluntary consent, which may be revoked at any time with effect for the future in text form. Revocation does not affect the lawfulness of use up to that point; printed matter already distributed does not have to be recalled.

(4) Participants undertake not to use personal data of other participants of which they become aware in the context of the Event or via the app for commercial purposes, not to make it accessible to third parties and not to use it for their own advertising.

(5) Retention. We retain registration data and associated master data for ten years due to obligations under commercial and tax law. This also applies if access to the app is deleted.

§ 15 Communication and Form

(1) Declarations within the framework of this contract – in particular cancellation, withdrawal, termination, objection – require text form (e.g. email, letter). A stricter form is not required.

(2) The participant keeps the email address provided at registration functional and notifies us of any changes without undue delay. Notifications sent to the last known address are deemed to have been received.

(3) The language of the contract and of communication is German and – where offered by us – English, Spanish, Italian, Russian and others.

§ 16 Changes to These Terms

We reserve the right to amend these terms with effect for future contracts. For contracts already concluded, the version communicated at the time of conclusion of the contract applies. We will offer the participant an amendment to ongoing contracts in text form at least 6 weeks before it takes effect; it is deemed accepted if the participant does not object in text form before it takes effect. We will specifically point out this consequence in the offer of amendment.

§ 17 Final Provisions

(1) Applicable law. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers whose habitual residence is outside Germany, the mandatory consumer protection provisions of their country of residence remain unaffected.

(2) Place of jurisdiction. If the participant is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction is Tübingen. Statutory exclusive places of jurisdiction remain unaffected.

(3) Authoritative language version. These terms are provided in several languages. The authoritative version is the German version; the other versions serve to aid understanding.

(4) Consumer dispute resolution. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(5) Severability clause. Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.

PART B – SPECIAL CONDITIONS FOR ONLINE EVENTS

  • B1 Access. Access data will be sent by email in good time before the start. Access is personalised.
  • B2 Technical requirements. Participation requires an internet-enabled device and the use of the conference service specified in each case (currently Zoom). The participant is responsible for suitable hardware and software, a sufficient internet connection and the associated costs.
  • B3 Technical disruptions. The participant is responsible for a suitable internet connection and functioning devices. Disruptions originating from the participant's technical environment do not give rise to any claims against us. The same applies to disruptions at the conference service provider, unless we are at fault in its selection or organisation. If a session is cancelled entirely for a reason for which we are responsible, we will offer a replacement date or a recording. Further claims are governed by § 13.
  • B4 Recordings and prohibition of recording. §§ 11 and 14 apply. Participants are prohibited from making their own recordings, screenshots and screen recordings.

PART C – SPECIAL CONDITIONS FOR IN-PERSON EVENTS

  • C1 Services. Accommodation and meals are only included if this is expressly stated; otherwise they will be charged separately or must be booked by the participant.
  • C2 Deviating cancellation policy. The cancellation conditions of the respective conference venue, which are communicated in the event description, apply to accommodation and meals. They take precedence over § 7 para. 2.
  • C3 Travel. Travel to and from the venue and the stay are at the participant's own risk and expense.
  • C4 House rules. The house rules of the venue apply. Instructions from the event management and the venue staff must be followed.
  • C5 No supervision. There is no duty of care or supervision outside the event sessions. Accompanying children must be supervised by their parents or guardians; children may only take part in the sessions by prior arrangement.

PART D – SPECIAL CONDITIONS FOR THE APP, MEDIA LIBRARY AND DIGITAL CONTENT

  • D1 Subject matter. We provide digital content and services via the app “ISA – Spiritual Activity”, including its web version, and in individual cases via separate, personalised access links or embedded content on our websites (practice prompts, audio and video content, course materials). The provisions of this Part D apply to all these means of access.
  • D2 Access and account. Use requires a personal user account. Login takes place via the stored email address and a one-time code valid for a limited period. Access is tied to the participant; registered devices are recorded in order to protect access against unauthorised sharing. One-time codes and access may not be passed on. The participant is responsible for actions carried out via their account, insofar as they are responsible for them. The participant keeps their email address up to date and informs us without undue delay if they lose control of their account.
  • D2a Personal notes. Notes that the participant creates in the app on the practice cards are additionally stored on our server so that they are available on multiple devices. They are intended exclusively for the participant and are not evaluated by us. The participant is responsible for making their own backup of particularly important notes.
  • D3 Scope and duration of provision. Access is provided for the period stated in the event description, at least for the duration of the associated Event. Beyond that, access generally remains available as a voluntary service for approximately twelve further months; there is no entitlement to any particular period of availability beyond the duration of the Event.
  • D4 Availability. We endeavour to ensure availability that is as uninterrupted as possible, but do not guarantee uninterrupted accessibility. Maintenance work, disruptions to transmission channels and outages at third-party providers (hosting, CDN, app stores) may lead to temporary restrictions. Where possible, we will announce planned maintenance in advance.
  • D5 Changes to digital products. We may modify the app and the content provided, in particular to adapt it to a new technical environment, to increase security or for further development. If a change results in more than an insignificant impairment, we will notify the participant of this in good time in text form; the participant will then be entitled to the statutory rights.
  • D6 App stores. Obtaining the app via the Apple App Store or Google Play is additionally subject to the terms of the respective store operator. We remain the contractual partner for the content.
  • D7 Devices. System requirements are stated in the respective store description. The participant is responsible for the suitability of their own devices.
  • D8 List of participants. The app may show who else is taking part in the current course. This display is switched off by default and only becomes visible with the participant's express consent; consent may be withdrawn at any time in the settings. The first name, the first letter of the surname, and the city and country are displayed. This information is visible only to participants of the same course.
  • D9 Community and couchsurfing area.
  • If the participant additionally consents to being included in the community area, their information is also accessible to all persons who belong to our community (current and former participants, members of the association and persons associated with the association). This consent is also voluntary and may be revoked at any time.
  • The couchsurfing area serves solely to enable participants to find each other and make contact themselves. We do not arrange accommodation, do not check offers and do not become a party to any agreement between participants. Arrangements regarding stays, accommodation or cost-sharing are made exclusively between the persons involved and are at their own responsibility and risk. We are liable only in accordance with § 13.
  • The information accessible via the list of participants and the couchsurfing area may be used exclusively for personal contact within the community. In particular, the systematic reading, storing or exporting of this information, its disclosure to third parties and any advertising, commercial or political solicitation are prohibited.
  • In the event of violations of paragraph 3 or harassing behaviour towards other participants, we may block access to these areas; § 9 para. 3 remains unaffected.
  • D10 Deletion of access. The participant may delete their app access themselves at any time. Deleting access does not terminate the participation contract and does not give rise to any entitlement to a refund of the participation fee; termination of the contract is governed by §§ 6 and 7. Upon deletion, access to course content, recordings and personal notes is lost; restoration is not possible. Registration and master data subject to retention obligations remain stored in accordance with § 14 para. 5.
  • D11 Right of withdrawal for digital content. For digital content, the right of withdrawal under § 6 and Annex 1 Section 1 applies without restriction. It does not expire because content is provided or used before the withdrawal period has expired.

PART E – SPECIAL CONDITIONS FOR MATERIALS AND DELIVERY OF GOODS

  • E1 Subject matter. Printed working materials, card sets, books and similar materials are – insofar as included in the participation fee or ordered separately – sent to the delivery address provided at registration. For group registrations, materials are sent as a consolidated shipment to an address specified by the registering person; distribution within the group is that person's responsibility.
  • E2 Delivery. The delivery time is stated in the respective product description. For deliveries abroad, customs duties, import taxes and fees may be incurred, which are borne by the participant.
  • E3 Retention of title. The goods remain our property until full payment has been made.
  • E4 Return after withdrawal. In the event of withdrawal, goods that are a subject of the contract under § 2 para. 4 lit. b and separately ordered materials must be returned without undue delay, at the latest within 14 days. Working materials under § 2 para. 4 lit. a do not have to be returned. The participant bears the direct costs of the return.
  • E5 Warranty. The statutory rights in respect of defects apply.
  • E6 Free promotional materials. We provide posters, postcards and similar materials for publicising our offerings free of charge upon request. There is no entitlement to delivery; we reserve the right to limit the quantity or to refrain from supplying them. The materials are intended exclusively for publicising our Events and may not be altered, resold or used for third-party offerings.

ANNEX 1 – INFORMATION ON THE RIGHT OF WITHDRAWAL

1. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us

Leben im Denken e.V., Stäudach 46, 72074 Tübingen, Germany
Email: info@spiritual-activity.org

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

2. Right of withdrawal for contracts that include the delivery of goods

If the contract also includes the delivery of goods that are a subject of the contract according to the event description (§ 2 para. 4 lit. b), or if you order materials independently of a participation contract, the following applies to the start of the withdrawal period:

In the case of a contract for the regular delivery of goods over a defined period, the withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the first goods.

In all other cases, the withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last goods.

Otherwise, Section 1 applies accordingly.

3. Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Return of goods. For orders of goods under Section 2, you shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Working materials provided within the framework of a participation contract (§ 2 para. 4 lit. a) do not have to be returned.
